17.3 Resignation for equipment injury. Any party may terminate the agreement immediately after notification if the other party does not comply with its substantial obligation under this agreement and is not the subject of an infringement within thirty (30) days from the date on which it is notified. Each party reserves the right to terminate the agreement immediately after the written announcement, but does not grant a healing period to the other party if the Client violates any of the terms of the present GitHub Intellectual Property Agreement (including compliance with the license and possible license restrictions by the client) or the confidential information of one of the contracting parties. The open source license for the software is included in the “Open Source Notices” documentation that is included in the software. This documentation also contains copies of all applicable open source licenses. 8.3 Add-on Software. The add-on software is allowed per user. In order to avoid any doubt and unless otherwise stated in an order form, the number of subscription licenses that the Customer has at any given time for the add-on software must correspond to the number of subscription licenses available to the Customer for the products covered by this Agreement. For example, if the customer wants to purchase a subscription to Advanced Security and already has subscription licenses for 100 users for the products, they must purchase subscription licenses for 100 users for enhanced security.

“subscription license,” the license given to each user for the installation, operation, access and use of the software on behalf of the customer. Customers can only assign a subscription license per user through their GitHub Enterprise server instances. Each user has access to most of the client`s business servers, as the customer allows. However, for clarity reasons, the customer is not allowed to plug in the subscription license as soon as the customer assigns a subscription license to a user, so one user can use a subscription license on Enterprise Server, while another user uses the same subscription license on another Instance of GitHub Enterprise Server. This end-user license agreement (EULA) is a legal agreement between you (either as an individual or on behalf of an entity) and GitHub, Inc. regarding your use of GitHub desktop applications, including GitHub DesktopTM for Mac and Windows and associated documentation (the “software”). IF YOU DON`T GO THROUGH ALL THE TERMS OF THIS EULA, DON`T INSTALL IT, DON`T USE IT OR COPY THE SOFTWARE. 15.3 Exceptions. The exclusions and restrictions set out in this section 15 do not apply to responsibilities arising from (1) the client`s failure to comply with the licence or licence restrictions covered by Points 2 and 3; (2) the defence obligations of one of the section 14 parties; or (c) breach of their confidentiality obligations in Section 16. The software automatically communicates with GitHub servers for three purposes: (1) Software update; (2) sending bug reports; and (3) send anonymized usage data so we can improve the software. You can disable the transmission of anonymized usage data, but if you don`t want the software to be automatically updated or send bug reports, you need to uninstall the software. 12. Professional services. At the customer`s request for professional services, GitHub provides a SOW that provides detailed professional services. GitHub performs the professional services described in each SOW. GitHub monitors the way professional services are performed and reserves the right to designate assigned staff. GitHub may use third parties to perform professional services, provided GitHub remains responsible for their actions and omissions.
